General Conditions of Sale of the website www.outletcaffe.shop

The sale of products on our website ("www.outletcaffe.shop") is governed by these General Conditions of Sale.

1. Our trade policy

The Seller carries out its e-commerce activity exclusively towards its end users who have reached the age of majority and who are "consumers".

When we speak of "consumer" we refer to any natural person who acts on www.outletcaffe.shop with purposes not related to his own commercial, entrepreneurial or professional activity, possibly carried out. In consideration of its commercial policy, the Seller reserves the right not to accept purchase order proposals from parties other than the "consumer" or in any case purchase order proposals that do not comply with its commercial policy, such as, for example, proposals for orders for which there is a report, or suspicion, of fraudulent or illegal activity. In such cases, the Seller will notify the user of the non-acceptance of the order proposal.

All order proposals sent to the Seller and returns made by users must also correspond to normal consumption needs. The Seller therefore monitors the number of order proposals sent and returns made.

These General Conditions of Sale exclusively regulate the sending of purchase order proposals for products available on www.outletcaffe.shop by the user and their acceptance by the Seller.

2. Information aimed at concluding the contract with the Seller pursuant to Legislative Decree 9 April 2003, n. 70
2.1
To conclude the purchase contract for one or more products on www.outletcaffe.shop, you must electronically send a purchase order proposal to the Seller by filling in the form available on www.outletcaffe.shop and following the relative instructions.

2.2
Before sending the order proposal, we remind you to carefully read the General Conditions of Sale and the Information on the Right of Withdrawal, to print a copy using the print command and to store or reproduce a copy for your personal use. . In compliance with article 51, paragraph 7, of the Legislative Decree 6 September 2005, n. 206 (the "Consumer Code"), before transmitting the order proposal, we will provide you with a summary of the commercial and contractual conditions that will apply to your product purchase order proposal and a summary of the information on the essential characteristics of each product ordered with the relative price (including all applicable taxes or duties), the means of payment that you can use to purchase each product, the methods of delivery of the products purchased, the shipping and delivery costs; as well as the references, the geographical address and the contact methods of the Seller and the date by which the Seller, once accepted your order proposal, undertakes to deliver the goods. The Seller will also provide you with a summary of the conditions and methods for exercising your right of withdrawal. If applicable, you will be informed that, in the event of withdrawal, you will have to bear the cost of returning the products. In any case, you will be reminded of the existence of the legal guarantee of conformity of the products, you will be provided with the contact details of our after-sales service.

On the confirmation page of the order proposal, which contains a reference to the General Conditions of Sale and the Information on the Right of Withdrawal, we will provide you with summary information about the essential characteristics of each product indicated in your order proposal, the price (including all applicable taxes or duties) and shipping costs (including any additional costs incurred by you for choosing a different and / or faster type of shipping and delivery than the standard one).

2.4
The transmission of the order proposal to the Seller constitutes a binding purchase proposal for the user. Before proceeding with the transmission of the order proposal, you will therefore be asked to identify and correct any data entry errors.

2.5
Once your order proposal has been sent, you will receive an automatic e-mail from the Seller to confirm the receipt of your order proposal. Receipt of the aforementioned email does not constitute acceptance of your order proposal.

2.6
The contract is concluded when your order proposal is accepted by the Seller. The Seller will send you a second e-mail to confirm the acceptance of your order proposal and the shipment of the products. This email will also contain a copy of the General Conditions of Sale and the summary document on the Right of Withdrawal.

2.7
The order proposal sent to the Seller will be archived in our database for the period of time necessary to process the order proposals accepted by the Seller and in any case in accordance with the law. You will be able to access your order proposal form by consulting the My Order section.

2.8
The language available to conclude the contract with the Seller is Italian.

2.9
The Seller accepts orders with prepayment issued through the certified PAY PAL and CREDIT CARD channels. The Seller does not accept orders that are not ascertained the advance payments.

In these cases, we will inform you by e-mail that the contract is not concluded and that the Seller has not accepted your purchase order proposal, specifying the reasons. If the products, presented on www.outletcaffe.shop, are no longer available or on sale at the time of receipt or processing of your purchase order proposal, it will be the Seller's responsibility to notify you promptly and in any case within thirty (30) days from the day following that on which you have sent your order proposal to the Seller, any unavailability of the products. If you have already paid the price for the products, the Seller will reimburse, without undue delay, what you have already anticipated and the sales contract will be considered terminated.

The Seller also reserves the right not to accept purchase order proposals in the cases referred to in paragraph 1.3 above.

2.10
We remind you that, with the electronic transmission of the order proposal, you unconditionally accept and undertake to observe these General Conditions of Sale in relations with the Seller. If you do not agree with some of the terms set out in the General Conditions of Sale, please do not submit your order proposal for the purchase of products on www.iottigioielli.it.

2.11
By submitting the order proposal, you confirm that you also know and accept the additional information contained in www.iottigioielli.it, also referred to through links, including the General Conditions of Use and the Privacy Policy and the Information on the Right of Withdrawal .

3. Guarantees and indication of product prices
3.1
The Seller exclusively sells original and own brand products in capsules, products for cleaning coffee machines and various accessories.

These products are purchased directly by the Seller from carefully selected manufacturers and retailers for their rigorous quality controls.

3.2
The Seller does not sell second-hand products, flawed products or products of lower quality than the corresponding standards offered on the market


3.3
The essential characteristics of the products are presented on www.outletcaffe.shop within each product sheet. However, the images and colors of the products presented on www.outletcaffe.shop may not correspond to the real ones due to the Internet browser and monitor used. The manufacturers who own the brands reserve the right to change product and / or image at any time, and will be updated as soon as possible by the Seller in the sales window of the specific product.

3.4
Product prices may be subject to updates. Make sure of the final sale price before submitting the related order proposal.


3.5
All products are packaged and sealed by the manufacturer and not handled by the Seller.

3.6

All products sold by REGGIANA DISTRIBUTORI SRL through the website www.outletcaffe.shop are covered by the legal guarantee for food products. If the food product is defective, it must be promptly communicated to the Seller within 7 (seven) days of its discovery. The defective product can be communicated to the Seller by contacting Customer Service by email at info@outletcaffe.shop. In the event of a defective product, you have the right to request the replacement of the product or a refund.

4. Payments
4.1
To pay the price of the products and the shipping and delivery costs, you can follow one of the methods indicated in the order proposal form. In no case will you be charged costs higher than those actually incurred by the Seller, in relation to the payment instrument you have chosen.

4.2
The payment methods accepted by Reggiana Distributori srl are: Paypal, Visa Mastercard Credit Card and Bank Transfer.

With the payment by bank transfer, the data for the issuance of the invoice will be requested (for private individuals the tax code, for companies VAT number and SDI code for electronic invoicing)

4.3
In case of payment by credit card, the financial information (for example, the credit / debit card number or the date of its expiry) will be forwarded, via encrypted protocol, to the service provided by Paypal, which provide the related services remote electronic payment, without third parties having access to it in any way.
Furthermore, this information will never be used by the Seller except to complete the procedures relating to your purchase and to issue the related refunds in the event of any product returns, following the exercise of your right of withdrawal.
The price for the purchase of the products and the shipping costs, as indicated in the order proposal, will be charged to your current account at the time of shipment of the purchased products.

5. Shipping and delivery of products
5.1

7. Right of withdrawal
7.1
In compliance with art. 52 of the Consumer Code, you have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) days, starting from the day of receipt of the products purchased on www.outletcaffe.shop unless the packages purchased are sealed and / or not damaged. After 14 days, the return is charged to the buyer and in case of replacement, the new shipping costs will also be charged, or for the reimbursement of the goods only, net of the costs incurred at the first shipment.

7.2
In compliance with art. 54 of the Consumer Code, you can withdraw from the contract concluded with the Seller using, at your choice, one of the following methods:

a) contact the Seller by email info@outletcaffe.shop by filling in the personal data and the order number reference in order to monitor the return and issue the refund when due.


b) the goods must be sent to REGGIANA DISTRIBUTORI SRL, via Adua n. 24 / A 42124 Reggio Emilia

7.3
In compliance with art. 57 of the Consumer Code, once the withdrawal from the contract has been exercised, you will have to return the products to the Seller by delivering them to the courier for shipment within fourteen (14) days from when you notified the Seller of your decision to withdraw from the contract.

7.4
The only expenses at your expense are those for returning the purchased products.

7.5
The return will be fully charged to the Seller only in the case of defective goods or errors in sending goods by the Seller.
It is understood that, in this case, an amount equivalent to the cost of the standard shipping of the purchased products will also be refunded, while, in accordance with art. 56, paragraph 2, of the Consumer Code, any additional costs incurred by you for choosing a different and / or faster type of shipment and delivery than the standard one will not be reimbursed. In this case, your responsibility may remain in the event of loss or damage to the products during transport, which is due to your negligent choice of the carrier and / or of the shipping methods.

7.6
The right of withdrawal - in addition to compliance with the terms and methods described in paragraphs 7.1, 7.2,7.3 and 7.4 above - is understood to be exercised correctly if the following conditions are also fully met:

to. the right of withdrawal must be duly exercised within fourteen (14) days of receipt of the products;

b. the products must not have been used,

c. the package must be sealed and unopened as received from the manufacturer;

d. the products must be returned in their original and unopened packaging;

And. the returned products must be delivered to the shipper within fourteen (14) days from when you notified the Seller of your decision to withdraw from the contract;

f. the products must not be damaged.

Pursuant to art. 59 of the Consumer Code of food products, the right of withdrawal is also excluded in the event that you have purchased packaged / sealed products and return them open or sealed goods that do not lend themselves to being returned for hygienic / food reasons or related to the protection of health and were opened after delivery.

7.7
The Seller will make the necessary checks in order to verify the conformity of the returned products to the conditions and terms indicated in paragraph 8.7 above.

If the right of withdrawal is exercised following the methods and terms indicated above, the Seller will send you, via e-mail, the relative confirmation of acceptance of the products thus returned and to reimburse any sums already collected for the purchase of the products. according to the terms and conditions provided.

7.8
The sums will be refunded to you as soon as possible only after receiving the goods and accurate control checks.

7.9
If the methods and terms for exercising your right of withdrawal are not respected, referred to in letters a), e) and f) of the previous paragraph 7.6 or in the hypothesis referred to in art. 59 of the Consumer Code, you will not be entitled to a refund of the sums already paid to the Seller. The Seller will notify you by e-mail of the non-acceptance of your return. Within 14 days of receiving the Seller's e-mail, you can choose to get back, at your expense, the products in the state in which they were returned to the Seller, notifying the Seller, according to the methods that will be communicated to you. Otherwise, the Seller may keep the products, in addition to the sums already paid for their purchase.

If, on the other hand, the Seller's checks show that the conditions referred to in letters b), c) and d) of paragraph 7.6 above are not met, you will not be entitled to a full refund of the sums already paid to the Seller. In compliance with art. 57, paragraph 2, of the Consumer Code, you will, in fact, be responsible for the decrease in value of the returned products, resulting from a use other than that necessary in order to allow you to ascertain the nature, characteristics and functioning of the products themselves. In this case, the amount of the goods that arrived open and / or damaged will be deducted from the refund provided.

The Seller assumes no responsibility in the event of products returned by mistake or items forgotten in packages or returned products.

8. Times and methods of reimbursement
8.1
Whatever the payment method you use, the refund due, in whole or in part, is activated by the Seller, in the shortest possible time only after receipt of the goods at the Seller's headquarters, after verifying the correct execution of your right of withdrawal and verification of returned products.

8.2
The Seller reimburses using the same payment method you used for the purchase of the returned products.

8.3
We remind you that the value date of the re-credit will be different from that of the debit.

10. Applicable law and dispute resolution

Without prejudice to the application of the mandatory rules of European derivation to protect the consumer, the General Conditions of Sale are governed by Italian law and in particular by the Consumer Code and by Legislative Decree 9 April 2003, n. 70 (“Implementation of Directive 2000/31 / EC relating to certain legal aspects of information society services in the internal market, with particular reference to electronic commerce for food products”).

10.2
In the event of a dispute emerging from this contractual relationship, the parties undertake to seek, before any legal action, a solution dictated by common sense.

10.3
For all disputes relating to the purchase and / or these General Conditions of Sale for which a solution has not been found as per point 10.2, the Court of the place of domicile or residence of the consumer will be competent according to the applicable law or, at the choice of the consumer himself, the Court of Reggio Emilia.

11. Modification and updating

11.1
The General Conditions of Sale are amended from time to time by the Seller also in consideration of any regulatory changes. The new General Conditions of Sale will be effective from the date of publication on www.outletcaffe.shop
